This position is responsible for overall management and day to day operations of Arizona's Department of Occupational Safety and Health (ADOSH), which plays an important role in promoting safe and healthy workplace for the workforce in the state.

Subject to the control and direction of the Commission and Agency Director, the ADOSH Administrator also established and implements policy and procedure related to the various sections within ADOSH such as: Compliance (Inspection), Consultation, Administration which includes: Whistleblower and Intake and the Statistics Program. Some of these programs operate under Federal Grants, the management of which are overseen by the ADOSH Administrator.

The ADOSH Administrator is also responsible for ensuring that the State's program is at least as effective as the Federal OSHA Program, which is required under the state plan agreement. In addition to the on-going and day to day responsibilities associated with this responsibility, the ADOSH Administrator is also responsible for working with and communicating directly (and regularly) with stakeholders, employers and employer organizations, and Federal OSHA, working closely with Federal counterparts to ensure that necessary program changes are implemented, that overall division goals are achieved, and that any noted deficiencies are corrected in a timely manner.

With both supervisory and direct responsibilities, the responsibilities are varied and complex, requiring extensive knowledge of Arizona and Federal Occupational Safety and Health law, standards, regulations, rules, directives and interpretation, as well as knowledge of the regulatory framework within which these laws exist.

This position may offer the ability to work remotely, within Arizona, based upon the department's business needs and continual meeting of expected performance measures.

Essential Duties and Responsibilities include but are not limited to:
● Review ADOSH inspection files prior to citation issuance compliance with applicable laws and procedures.
● Prepare and present the citations to the Industrial Commission for approval of the recommended penalties and citations.
● Review results of informal settlement conference to ensure that proposed settlements are consistent with the goals of ADOSH.
● Attend pre-hearing settlement conferences and participate in settlement discussions, approving settlements as appropriate and taking such action as may be needed to implement settlement terms.
● Confer with ICA Legal Division attorneys regarding litigation and settlement of contested citations/penalties.
● Establish strategic plan and direct the activities of the ADOSH staff consistent with the plan and the Arizona Management System principles.
● Preside over staff meetings and supervisory meetings.
● Review reports for the purpose of ensuring the division is on track to meet goals and identify any potential problems.
● Instruct staff on changes necessary to ensure continued effectiveness of the division.
● Speak at public meetings, seminars, training courses, etc. on matters related to ADOSH program and activities.
● Represent ADOSH at public meetings, conferences, advisory committee meetings.
● Prepare grant applications, including strategi and performance plans and goals, for submission to federal OSHA.
● Approval of all division purchases within the ICA approval process.
● Ensure that division operates within budget.
● Writes letters, memos, and other forms of written communication to federal OSHA staff, other agencies, and employers.
● Visits work sites to assist employers, make presentations, observe, and inspect conditions and make recommendations regarding observations.
● Conduct 1:1s with direct reports.

Knowledge of
● The principles of the Arizona Management System leadership model.
● Arizona Revised Statutes that related to the administration of the state OS&H program, including Titles 23, 38 and 41.
● Policies, procedures, and administrative rules of the Industrial Commission and the Department of Occupational Safety and Health.
● Arizona Occupational Safety and Health Act of 1972, the standards and rules adopted under the Act, and applicable case law.
● The Arizona Boiler Safety Act of 1977, the standards/rules adopted under the Act, and applicable case law.
● The Arizona Elevator Safety Act of 1978, the standards/rules adopted under the Act and applicable case law.
● The Federal requirements regarding the administration of a State OS&H program.
● The jurisdiction, objectives, goals responsibilities and operational parameters for administering a federally approved state program.
● State and federal budgetary processes and requirements.
● Safety and health hazard recognition, avoidance, and elimination, including their levels of severity, toxicological effects, implications, and acceptable means of abetment for such hazards.

The ideal candidate for this position will have:

Previous work experience with ADOSH, Federal OSHA or other state approved OS&H plan, risk management, or other safety related positions.

A.R.S 23-406 requires that this position be filled by a person who meets the following three requirements:
1. Has been employed in the safety or health profession a minimum of ten years in the aggregate and is currently engaged in the broad practice of safety or health or one of its relevant specialties, or holds a degree from an accredited college or university appropriate to the field of safety and health and has a minimum of five years' experience in the broad practice of safety or one of its relevant specialties; and
2. Has been registered or licensed by a state agency as professional appropriate to his field of safety and health, or has been certified as competent with the broad practice of safety or health or one of its relevant specialties by an organization recognized as qualified a such as the American Society Engineers or American Industrial Hygiene Association; and
3. Competent to deal with the planning, design and needs of business operations as the use of such operations relates to the safe, convenient, and economic performance of their business functions, with not less than three years' experience in an administrative capacity in the field of occupational safety and health.

If this position requires driving or the use of a vehicle as an essential function of the job, then the following requirements apply. Any employee operating a motor vehicle on State business must possess and retain a current, valid class-appropriate driver’s license, complete all required training, and successfully pass all necessary driver’s license record checks. The license must be current, unexpired, and neither revoked nor suspended. Employees who drive on state business are subject to driver’s license record checks, must maintain acceptable driving records, and must complete all required driver training. An employee who operates a personally owned vehicle on state business shall maintain the statutorily required liability insurance (see Arizona Administrative Code (A.A.C.) R2-10-207.11).
