Requisition No: 877547
Agency: Office of the Attorney General
Working Title: ASSISTANT ATTORNEY GENERAL-DLA - 41000147
This is a re-advertisement. Prior applicants need not re-apply
Our Organization and Mission:The Office represents the State of Florida in state and federal civil and criminal courts, from trial courts to the Supreme Court of the United States.
Pay: $83,522.92 Annually
Position Summary: This is an Assistant Attorney General position within the Office of the Attorney General, Civil Legal Services – Commission on Ethics.
Qualifications:
Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class.
The Work You Will Do:This position’s duties include but not limited to the following:
Reviews complaints filed with the Commission on Ethics which are determined legally sufficient to state a violation of the Code of Ethics for Public Officers and Employees and prepares Advocate's Recommendation for each case, which requires analysis of case facts and research of applicable case law and Opinions of the Commission on Ethics, as well as consultation with Commission staff. The senior assistant attorney general will have greater responsibility for the more sensitive and complex cases. These cases frequently have statewide impact and influence the policy direction of state government. These cases frequently involve emergencies regarding matters of great public importance where response time is minimal and demands are great. This office relies on the experience and leadership of senior level attorneys to provide guidance to the younger attorneys in the office. Since it can be difficult to draw bright-lines separating litigation issues from standard operational issues, all attorneys must be prepared to provide counsel and guidance to agency and official clients on case-related issues and other topics that may be only indirectly related to a specific case but that nevertheless can have an impact on the client’s litigation goals.
Makes oral presentations of recommendations before Commission on Ethics and responds to questions from Commission and arguments of counsel for Respondents.
Prepares cases for public hearing before hearing officer(s) and negotiates stipulated settlement of cases, including preparation of necessary pleadings and documents and investigation of cases, deposing witnesses as necessary.
Conducts prosecution of cases at public hearings in Tallahassee and elsewhere in state, including preparation of findings of fact and exceptions to Recommended Public Report of hearing officer.
Participates in appellate litigation of orders of Commission on Ethics which are appealed to higher courts.
Prepares and files pleadings and prosecutes actions pursuant to s.112.317(2), Fl.S., to collect penalties recommended by Commission on Ethics and imposed by appropriate entity or Officer which are unpaid.
Performs related work as required.
Candidate Profile (application) must be completed in its entirety.
Include supervisor names and phone numbers for all periods of employment.
Account for and explain any gaps in employment so that the hiring process is not delayed.
Experience, education, training, knowledge, skills and/or abilities as well as responses to pre-qualifying questions must be verifiable to meet the minimum qualifications.
It is unacceptable to use the statement “See Resume” in place of entering work history.
If you experience problems applying online, please call the People First Service Center at (877) 562-7287.
