Position Summary

The Attorney position provides support to the Company's Legal Department by monitoring legislative and regulatory developments; supporting the Company's government relations and industry advocacy efforts; responding to keeper of records requests, subpoenas, summonses, and other legal process seeking company records; reviewing and tracking bankruptcy and lien notices; advising internal business partners on compliance obligations; and assisting with regulatory matters. Working under the direction of the Legal Director, this position helps ensure that the Company remains compliant with applicable insurance laws and regulations while advancing the Company's strategic business objectives.

Essential Duties and Responsibilities

Legislative and Regulatory Monitoring (Government Affairs)

Monitor legislative, regulatory, and political developments affecting the property and casualty insurance industry in Massachusetts, New Hampshire, Maine, and other jurisdictions of strategic importance.

Monitor industry publications, regulatory bulletins and guidance, and trade association communications for developments affecting Company operations.

Track significant legal and regulatory initiatives before the National Association of Insurance Commissioners (NAIC) and evaluate their potential impact on Company operations.

Participate in trade association meetings, conference calls, and industry working groups, including those sponsored by the Massachusetts and Rhode Island Insurance Federation (MARIIF), the American Property Casualty Insurance Association (APCIA), and other industry organizations.

Gather and analyze proposed legislation, regulations, bulletins, and regulatory guidance from regulators, trade associations, and other industry resources and prepare written summaries and recommendations for Legal Director and business stakeholders.

Assist departments in evaluating the operational impact of legal and regulatory changes and developing compliance policies, procedures, and business practices.

Legal Process

Serve as the Company's primary legal contact for responding to keeper of records requests, subpoenas, summonses, and other legal process seeking Company records.

Review, analyze, and respond to subpoenas, court orders, and records requests to ensure compliance with applicable laws, regulations and Company policies.

Coordinate with internal departments to identify, collect, review, and produce responsive records in a timely and legally compliant manner.

Maintain procedures for tracking legal process, response deadlines, and document productions, and ensure appropriate record retention and documentation.

Communicate with attorneys, courts, governmental agencies, and third parties regarding the scope, timing, and administration of records requests and legal process.

Identify issues requiring escalation to the General Counsel or senior attorneys and assist in resolving complex or sensitive legal process matters.

Regulatory Affairs

Assist in preparing responses to regulatory inquiries, consumer complaints, data calls, investigatory requests, and other governmental communications in collaboration with business units and senior management.

Bankruptcy and Lien Notices

Review and track bankruptcy and lien notices and correspondence for company compliance and disposition.

Maintain the Company's bankruptcy filing and lien notices database.

Communicate bankruptcy and lien information to underwriting, premium audit, and other operational departments.

Coordinate with business units as necessary.

Additional Legal Department Responsibilities as Assigned

Conduct legal research on insurance regulatory, legislative, and operational matters.

Assist with special projects and other legal matters.

Research legal and regulatory issues affecting Company operations and provide practical legal guidance to internal clients.

Draft and review internal compliance materials, regulatory communications, agent bulletins, and implementation guidance.

Assist with drafting and revising Company policies and procedures to reflect legal and regulatory requirements.

Represent company in matters before the MA DOI’s Board of Appeal (“BOA), as needed, including preparation and submission of detailed and extensive written memorandum in support of cancellation and testifying before ether the BOA.

Maintain and prepare content for the Legal Department website.

Draft ERP and limited producer termination correspondence.

Qualifications

Juris Doctor (J.D.) from an accredited law school.

Admission to practice law in Massachusetts, or eligibility for prompt admission.

3 to 5 years of legal experience, preferably in insurance regulatory, insurance coverage, compliance, government affairs, or financial services.

Knowledge of property and casualty insurance laws and regulations is preferred.

Familiarity with insurance regulatory agencies, NAIC model laws, and legislative processes is preferred.

Knowledge, Skills, and Abilities

Strong legal research, analytical, and writing skills.

Ability to interpret statutes, regulations, and regulatory guidance and communicate practical business advice.

Excellent organizational skills with the ability to manage multiple projects and competing deadlines.

Strong interpersonal and communication skills with the ability to work collaboratively across departments.

Ability to develop productive relationships with regulators, trade associations, and industry stakeholders.

Sound judgment, professionalism, and discretion in handling confidential and sensitive matters.

Proficiency in Microsoft Office and legal research platforms.
