Responsibilities

The Claims Counsel is responsible for the independent management of complex excess trucking liability claims. This includes high-severity bodily injury, property damage, environmental exposures, and catastrophic losses. The role demands advanced technical expertise, strategic litigation oversight, and the ability to resolve claims efficiently while protecting the company’s financial and reputational interests.

 

Key functions include but are not limited to:

 

  • Handle a caseload of complex excess trucking claims across multiple jurisdictions.
  • Evaluate coverage, damages, liability, and exposure; issue coverage position letters and retain coverage counsel as needed.
  • Monitor underlying carrier activity and coordinate with primary adjusters to ensure alignment and timely updates.
  • Conduct thorough investigations including review of pleadings, depositions, expert reports, and policy documents.
  • Negotiate settlements within authority or escalate with well-supported recommendations to senior leadership.
  • Guide litigation strategy in partnership with defense and coverage counsel.
  • Attend mediations, trials, and settlement conferences as necessary.
  • Analyze and manage risk transfer, additional insured, and indemnity issues.
  • Mentor and provide technical guidance to junior adjusters.
  • Participate in file reviews and contribute to continuous improvement initiatives.
  • Lead special projects and represent the claims department in cross-functional teams.
  • Maintain comprehensive and accurate claim file documentation.
  • Prepare clear and concise written and oral reports for senior management and reinsurers.
  • Ensure compliance with Medicare Set Aside and lien resolution protocols.

Qualifications

Education Requirements:

  • Bachelor’s Degree 
  • Juris doctor with litigation experience 
  • Professional designations such as AIC, SCLA, CPCU or RPLU preferred.

Qualifications:

 

  • Minimum 7 years of progressive claims experience or legal experience.
  • Ability to manage outside counsel.
  • Proven ability to manage high-limit claims (up to $25M policy limits).
  • Strong jurisdictional knowledge across multiple states, including litigation and regulatory environments.
  • Advanced analytical, negotiation, and communication skills.
  • Proficiency in claims systems and Microsoft Office Suite.
  • Ability to work independently and manage competing priorities.
  • Strong interpersonal skills and ability to collaborate across departments.
  • Experience with trucking/rail or intermodal claims is a plus.
  • Active participation in industry organizations and continuing education.

The company offers a competitive compensation plan and robust benefits package for full time regular employees which for this role include: • Base Salary Range: $83,000 - $155,000 • Eligible to participate in annual discretionary bonus. • Benefits: Health, Dental, Vision, Life, Disability, Wellness, Paid Time Off, 401(k) and Profit-Sharing plans. The actual salary for this position will be determined by a number of factors, including the scope, complexity and location of the role; the skills, education, training, credentials and experience of the candidate; and other conditions of employment.
